This “puppy” is a purebred Miniature Australian Shepherd. Upon the Buyer providing proof of spay/neuter, the Seller/Breeder will provide the buyer with the application for registration of the puppy with MASCA and/or NAMASCUSA.  Placitas is a registered kennel name. The first word of the registered name of this puppy will be Placitas. Proof of spay/neuter must be provided to the Seller/Breeder within ten months of birth of the puppy. Failure to provide proof of spay/neuter by ten months of age of puppy will result in forfeiture of all health guarantees and the Buyer must return the puppy to the Seller/Breeder at Buyer’s expense. If puppy is returned to Seller/Breeder due to lack of proof of spay/neuter the Buyer will forfeit the money, paid to purchase the puppy, to the Seller/Breeder. The Seller/Breeder Agrees: This puppy is guaranteed to be of sound health and free of known contagious diseases upon leaving our home. Seller/Breeder has vaccinated said puppy as required for its age at the time of this agreement. The Buyer agrees to have the puppy examined by a licensed veterinarian within 2 (two) days of receipt of the puppy, excluding weekends. If said puppy is found to be in poor health, as evidenced by a written statement from a licensed veterinarian, buyer will have 2 (two)options. Keep said puppy, assuming all costs for its care, or return the puppy, at Seller/Breeder expense, for a full refund of purchase price only upon Seller/Breeder receipt of the veterinarian’s written statement regarding the health of the puppy. This provision will expire 2 (two) days after Buyer takes possession of the puppy, excluding weekends. All puppies are sold with a 2 year (24 months) guarantee on hips and genetic defects as stated in Health Guarantee. The Seller/Breeder reserves the right to refuse the sale of one of our dogs to anyone. The Seller/Breeder will have first right of refusal if the Buyer, for any reason, decides they are not going to keep the puppy. Health Guarantees and Replacement: Breeder/Seller will replace or offer a refund with the written and signed statement from a licensed veterinarian for these genetic defects. 1.) Failure to receive a passing rating on hips from the Orthopedic Foundation for Animals (OFA) or Pennsylvania Hip Improvement Program (PennHIP). 2.) Failure to receive a normal reading from Canine Eye Registration Foundation (CERF) due to a defect that would cause loss of vision. Additional debilitating conditions due to genetic health problems must be discovered no later then 24 months from said puppy’s date of birth. They must be submitted with a written statement from 2 (two) veterinarians from differing clinics certifying that said puppy/dog is suffering from one of the following: thyroid, epilepsy, immune suppression. Buyer may then do one of the following: A) Buyer may keep the puppy with a refund of half purchase price of puppy. B) Return said puppy to Seller/Breeder at Buyer expense, for a replacement puppy of equal or greater value. C) If said puppy has to be put down due to these defects a replacement puppy of equal or greater value shall be given to Buyer upon Breeder/Seller receipt of proof that puppy has been put down. Buyer will sign over all registration papers to Seller/Breeder at such time that the puppy is returned to the Seller/Breeder. Seller/Breeder has the right to, at any time, decide to stop breeding Miniature Australian Shepherds. In this case, if a replacement puppy can not be given then all moneys from the purchase of said puppy will be refunded to Buyer. Seller/Breeder makes no guarantees regarding the loss of the puppy due to accidental death, theft, sickness due to lack of vaccinations, etc., or any other loss beyond the Seller/Breeder control except as stated above. The Buyer Agrees: Buyer certifies, by signing this agreement, that said puppy will live with the Buyer and this puppy will be given adequate and proper shelter and housed securely. If possible, this puppy should be sleeping in the house, in a crate large enough for its size at night. Puppy shall be given clean water and a good quality food in order to maintain a healthy weight and proper nutrition. Puppy food should only be fed until puppy reaches the age of 3 months. The puppy will be provided with adequate healthcare from a licensed veterinarian, including appropriate vaccination, and thereafter, yearly vaccinations including rabies. Buyer also certifies, by signing this agreement that he/she is not acting as an agent in this purchase; that the Buyer will not resell this puppy to a puppy mill, commercial breeder, pet store, guard dog business or medical research facility. If the Buyer decides, at any time during the puppies life, not to keep the puppy, then the Seller/Breeder has first right of refusal. If the puppy is returned to the Seller/Breeder for any reason other than reasons aleady addessed in this contract, the Seller/Beeder will pay half of the shipping costs to retun the puppy.  There will be NO refund of any amount for a puppy returned for any reason other than reasons aleady addressed in this contract.  If the Seller/Breeder doesn't exercise their right of first refusal than the puppy may be placed in another home that must be approved by the Seller/Breeder.   Buyer agrees that this contract is non-transferable. SHIPPING COSTS: Buyer agrees to pay the cost of vet check for health certificate, a crate for shipping the puppy in, the total cost for shipping the puppy. Buyer must have all funds for said puppy paid in full to Seller/Breeder 10 days prior to shipping and/or pick up or delivery. Buyer agrees that if funds for shipping and purchase are not received by the time the puppy is 12 weeks of age, unless prior arrangements have been made and agreed to in writing by both parties, the Buyer will forfeit all rights to the puppy. The $300.00 deposit will be retained by Seller/Breeder. There will be No C.O.D. deliveries. The Buyer has read and understands the foregoing and agrees that all parts of this contract constitute a binding agreement with the Seller/Breeder. Seller doesn’t guarantee that puppy will stay within size standards (i.e., 14” to 18” at the shoulders when fully matured). - Registration of the puppy will be in the name of the Buyer with Breeder/Seller listed as co-owner until the puppy is either spayed/neutered and proof of such is provided to the Breeder/Seller, or the puppy is bred according to the requirements of this contract. - Buyer agrees not to breed the puppy until the puppy is at least two years old. In the event of an “accidental” or “oops” litter, the Buyer agrees that the resulting litter of puppies are the property of the Breeder/Seller (Laurian Jaramillo) and all proceeds from sale of the litter/puppies will be paid to Laurian Jaramillo. - Buyer agrees not to breed the puppy unless the puppy is free of disqualifying faults as determined by the breed standard. - Buyer won’t breed the puppy if it doesn’t receive a passing grade for hips from either OFA or PennHIP as well as passing a CERF examination within one year prior to the breeding. - Buyer will only breed the puppy to a mate that has received a passing grade for hips from either OFA or PennHIP as well as passing a CERF examination within one year prior to the breeding. - Buyer agrees to only breed the puppy after puppy has acquired a title of Champion in either Conformation, Agility, or Herding. Buyer is required to notify Breeder/Seller of all accomplishments and titles earned by the puppy. - Buyer agrees that Breeder/Seller will have pick of two puppies from the first litter, as additional payment for a Show/Breeding puppy. Breeder/Seller will have to approve the mate for the first breeding. Upon receipt of this additional payment, the Breeder/Seller will transfer ownership/registration of the puppy to the Buyer and will relinquish co-ownership. - The Buyer has read and understands the foregoing and agrees that all parts of this contract constitute a binding agreement with the Seller/Breeder.
